What Happens If The Applicant Die After Entering The Lottery?

You became eligible for Green Card Lottery through cross chargeability. Say, you applied through your husband and your husband dies soon after you entered the lottery. You are the primary applicant on this application. What happens in this case?


I have seen legitimate materials from FAM (Foreign Affairs Manual) which mentions that the entire application will be revoked in this case. But in one of the letter from DOS (Directorate of Visa Services) one notes that the spouse and their children will be able to apply for a visa interview or an adjustment of status in case of primary applicants death. Often you will find that the cases are automatically revoked if the principal applicant dies. In this scenario, if moving to US is something you truly desire, get in touch with a lawyer. You lawyer might approach this case using ‘humanitarian re-instatement’. It is usually hard to get it approved, but its worth a try!
